Sparkapps.ai Terms of Service Agreement

This Terms of Service Agreement (“Agreement”) governs your use of all mobile applications (“Apps”) provided by Sparkapps.ai (“Company”), including but not limited to Chat Spark and Draw Spark, and any other applications we may offer in the future. By accessing or using our Apps, you agree to be bound by the terms and conditions outlined herein. If you do not agree with our terms, please do not use our Apps.

By creating an account, downloading, or using any of our Apps, you confirm your acceptance of these terms and your agreement to be a party to this binding contract.

2. Changes to Terms

The Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password.

4. Use of Services

• The Services allow you to create, edit, and share content generated through AI technologies.
• You retain all rights to the content you create but grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display the content in connection with the service provided by the Apps.

5. Prohibited Conduct

You agree not to use the Apps for any unlawful purpose or in any way that interrupts, damages, or impairs the service, including but not limited to:

• Uploading viruses or malicious code;
• Attempting to gain unauthorized access to any systems or networks connected to the Apps;
• Infringing on the intellectual property rights of others.

6. Intellectual Property

All rights, title, and interest in and to the Apps (excluding content provided by users) are and will remain the exclusive property of the Company and its licensors.

7. Privacy

Your use of the Apps is also governed by our Privacy Policy, which outlines how we collect, use, and share your personal information.

8. Children’s Privacy

Our Apps comply with the Children’s Online Privacy Protection Act (COPPA) and other relevant child protection laws. We do not knowingly collect personal information from children under the age of 13 without parental consent.

9. Disclaimers

The Apps are provided “as is,” without warranty of any kind. The Company does not guarantee the accuracy, completeness, or timeliness of the information available through the Apps.

10. Limitation of Liability

In no event will the Company, its affiliates, agents, directors, or employees be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of our Apps.

11. Governing Law

This Agreement shall be governed by the laws of the jurisdiction in which the Company is established, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising from or in connection with this Agreement shall be resolved through final and binding arbitration, conducted in the jurisdiction of the Company’s choosing.
