Terms of Service for Draw Spark

These Terms of Service (“Terms”) govern your access to and use of the Draw Spark mobile application (“App”), which is provided by Sparkapps.ai (“Company,” “we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Service Description

Draw Spark is an innovative mobile application that allows users to create drawings, which are then transformed by our AI-powered image recognition software into digital images. The App leverages advanced algorithms to interpret the shapes and spaces of your drawings, offering a unique creative experience.

2. User Eligibility

The App is available to users worldwide, subject to compliance with these Terms. Users under the age of 13 are not permitted to use the App without parental consent, in compliance with the Children’s Online Privacy Protection Act (COPPA) and similar regulations in other jurisdictions.

3. Account Registration and Use

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4. User Content

You retain all rights to the drawings and content you create using the App (“User Content”), but you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, modify, create derivative works, perform, and distribute your User Content on the App for the purposes of operating, developing, providing, and using the App.

5. Privacy

Your privacy is important to us. Our Privacy Policy, incorporated into these Terms by reference, explains how we collect, use, and share your personal information. By using the App, you agree to the collection and use of your information in accordance with our Privacy Policy.

6. AI Use and Transparency

In alignment with global regulations such as the EU GDPR and various U.S. state privacy laws, we commit to responsible AI use, including providing transparency about the AI processes used in the App, conducting regular impact assessments, and ensuring data accuracy and fairness.

7. Restrictions

You agree not to use the App for any unlawful purpose or in any way that interrupts, damages, or impairs the service. The use of automated systems or software to extract data from the App for commercial purposes, (‘scraping’) is prohibited unless you have obtained prior written permission from us.

8. Changes to the Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice through the App or by other means to provide you the opportunity to review the changes before they become effective. Your continued use of the App after we publish or send a notice about our changes to these Terms means that you are consenting to the updated Terms.

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of the Company’s headquarters, without regard to its conflict of law provisions.
